Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the Bot Connector mobile application for iOS (the "App"), the website at bot-connector.com (the "Site"), and any related services (collectively, the "Service") provided by Immigration Solutions ("we", "us", or "our"). The Service is a privacy tunnelling client that helps you encrypt your network traffic and route it through servers you choose. Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not install or use the App. Your continued use of the App after a new version of these Terms takes effect constitutes acceptance of the updated Terms. The App may also prompt you to re-accept these Terms inside the App when a new version is published; in that case acceptance inside the App is the controlling event for the purposes of this Section.

2. Eligibility

The Service is intended for users who are at least 13 years of age. By using the Service you represent and warrant that you are at least 13 years old and that you have the legal capacity to enter into a binding agreement under the laws of your country of residence. If you are between the age of 13 and the age of legal majority in your jurisdiction, you must use the Service only with the involvement and consent of a parent or legal guardian. We do not knowingly permit anyone under the age of 13 to use the Service, and any account, configuration, or other data we become aware of as belonging to a person under 13 will be removed at our discretion.

3. Licence Grant

Subject to your continuing compliance with these Terms, Immigration Solutions grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use the App on iOS devices that you own or control, solely for your personal, non-commercial purposes. This licence does not transfer any ownership rights in the App or in the Service to you. All right, title, and interest in and to the App, the Site, and the Service, including all intellectual property rights, remain with Immigration Solutions and its licensors. You may not copy, modify, organise the redistribution of, sell, lease, or create derivative works based on the App, except to the limited extent permitted by mandatory law that cannot be excluded by contract. The licence terminates automatically if you breach these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all laws and regulations that apply to you. You are solely responsible for ensuring that your use of the Service, including the network traffic you route through it and the server configurations you provide to it, complies with the laws of every jurisdiction in which you operate or in which the resources you access are located. You agree not to use the Service to engage in or facilitate any unlawful activity, to infringe the rights of any third party, to send unsolicited bulk communications, to distribute malware, to attempt to gain unauthorised access to systems you are not authorised to access, or to interfere with or disrupt any network, server, or service. You also agree not to abuse third-party services accessed through the Service, including by behaviour that violates the terms of service of remote endpoints. The legality of any specific server, protocol, or destination network you connect to is your responsibility, not ours.

5. User-Supplied Content

The App is a client. Immigration Solutions does not host, operate, or control any tunnel servers, subscription endpoints, or remote network resources. All server addresses, credentials, subscription URLs, routing rules, and other configuration data are supplied by you, retrieved by you from sources you choose, or generated on your device. You are solely responsible for the accuracy, lawfulness, and security of the configuration data you load into the App, for the trustworthiness of any third party from whom you obtain such data, and for the consequences of routing your traffic through any particular server. Configuration data is stored on your device and, where applicable, in the iOS Keychain. We have no access to your configuration data and do not transmit it to any server we control.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranty of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. Without limiting the foregoing, Immigration Solutions disclaims any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, that any defects will be corrected, that the App will be compatible with any particular device or iOS version, or that any specific server, protocol, or transport you use with the App will be available, performant, or reliable. Network conditions, server availability, and the policies of network operators are outside our control. Some jurisdictions do not permit the exclusion of certain warranties, in which case the exclusions in this Section apply to the maximum extent permitted by law.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Immigration Solutions, its affiliates, officers, directors, employees, or agents be liable to you or to any third party for any indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation damages for lost profits, lost revenue, lost business opportunities, lost data, loss of goodwill, or interruption or unavailability of network connectivity, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total cumulative liability for all claims relating to the Service will not exceed the greater of the amount you have paid us for the Service in the twelve months preceding the event giving rise to the claim, or ten United States dollars (USD 10). Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, in which case the limitations in this Section apply to the maximum extent permitted by law.

8. Termination

You may stop using the Service at any time by uninstalling the App from your device. Uninstalling the App removes any configuration data stored in the App's sandbox and the associated entries in the iOS Keychain. Immigration Solutions may suspend or terminate your licence to use the App at any time, with or without notice, if we reasonably believe that you have breached these Terms or that your behaviour exposes us, our users, or third parties to legal or security risk. Upon termination, all rights granted to you under these Terms will cease, and the provisions that by their nature should survive termination, including Sections 4, 5, 6, 7, 9, and 11, will survive.

9. Governing Law and Disputes

These Terms and any dispute arising out of or in connection with them or your use of the Service will be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. The parties agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware for the resolution of any such dispute, except that we may seek injunctive or equitable relief in any court of competent jurisdiction. Nothing in this Section limits any non-waivable rights you may have as a consumer under the mandatory law of your country of residence. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

10. Changes to These Terms

We may update these Terms from time to time. When we publish a material change, we will increment the version number recorded at the top of this document and update the effective date. The current version and effective date are also exposed by a metadata endpoint on the Site, which the App may consult in order to prompt you to re-accept the Terms before continuing to use the Service. Non-material changes, such as fixes to typos or formatting, may be made without bumping the version. We encourage you to review these Terms periodically.
